State Listings Inc. (Known as NY State MLS, LA State MLS, My State MLS) ByLaws

Article 1: Definitions:

Member:  A generic term relating to any Participant, Subscriber, Authorized User, Authorized User Member who access the NY State MLS and/or LA State MLS and/or My State MLS (known as the MLS) password protected area.

Participation: Participant/Subscriber (also known as authorized participant)

Participation Defined

Any Member of the MLS who is a principal, partner, corporate officer or branch office manager acting on behalf of a principal or other licensee as designated by the principal broker or otherwise acting on behalf of a principal or their firm, without further qualification, except as otherwise stipulated in these bylaws, shall be eligible to participate in the multiple listing upon agreeing to these terms of use (electronically or in writing) to conform to the rules and regulations thereof and to pay the costs incidental thereto

None of the foregoing is intended to convey participation or membership or any right of access to information developed by or published by the MLS where access to such information is prohibited by law.  The managing or principal of any firm, partnership corporation, or the branch office manager designated by said firm, or other firm's designee, partnership, or corporation as the participant shall have all rights, benefits, and privileges of the service, and shall accept all obligations to the service for the participant’s firm, partnership, or corporation, and for compliance with the by laws and rules and regulation of the service by all persons affiliated with the participant who utilize the service.  

The MLS is a means by which authorized participants make blanket unilateral offers of compensation to other participants (acting as subagents, buyer agents, or in other agency or non-agency capacities defined by law)

Licensee’s who are licensed with a firm that is a participant of the MLS may become a member/subscriber.

The Authorized Participant is the office designee.

Subscriber/Members Defined:

Subscriber Membership: Any licensed salesperson, associate broker, or otherwised licensed professional whose office has a participant may join and enter listings.  A subscriber may also be the firm’s participant or office designee if they are also the owner of the firm or the owner’s licensed designee.

A subscriber member may also be a licensed real estate appraiser, lending institution, attorney, real estate broker’s administrative assistant or other individual who may need access to the password protected portion of the site for the purpose of doing business in the valuation of real property.  These individuals may not enter listings into their account.  Office administrative assistants may enter listings into the accounts of their office licensees on behalf of the Participant.

Authorized User/Member:  Any user who can access the password protected portion of the MLS.

Article 2:

Purpose:

                 A Multiple Listing Service is a means by which authorized Participants make blanket unilateral offers of compensation to other Participants (acting as subagents, buyer agents, or in other agency or non-agency capacities defined by law): by which cooperation among the participants is enhanced; by which information is accumulated and disseminated to enable authorized Participants to prepare appraisals, analyses, and other valuations of real property for bona fide clients and customers;  by which Participants engaging in real estate appraisal contribute to common databases; and is a facility for the orderly correlation and dissemination of listing information so participants may better serve their clients and the public.  Entitlement to compensation is determined by the cooperating broker’s performance as a procuring cause of the sale (or lease).

Article 3:

Fees:      Fees can vary and may change from time to time.  The MLS may allow for different levels of membership to provide an affordable means of information sharing between Participants.  The MLS has the right to changes its fee structure at any given time.

Article 4:

The MLS is electronic. Listing information is accessed through an electronic portal.  To automate the sign up process, licensees may join through an on-line sign up form, however before have full access to their membership, members must validate their license information. MLS staff will confirm the members status. 

Article 5:

Anyone who accesses the password protected part of the MLS must agree to the member terms of use and agree to review the member’s terms of use on a regular basis as they may change from time to time.  Members must agree to the listing terms of use upon joining the MLS and upon entering of each listing into the MLS. The MLS has the right to change its terms of use at any given time.
